Employee relocation to Slovakia – staff requirements

In order to transfer personnel to Slovakia, the main regulation to respect is an EU Directive on Intra-Company Transfer which entered into effect in 2017. The visa is applicable to managers, specialists, and graduate trainees with non-EU residency who have been temporarily transferred for longer than 90 days from an organization outside the European Union to an entity in the same corporate group in the Slovak Republic.

Conditions for personnel relocation to Slovakia

In order to obtain an ICT visa for Slovakia, both employees and employers must fulfill specific criteria.

Employee transfer is only available for:

  • managers;
  • trainees;
  • skilled or key personnel.

The employment contract that details the candidate’s pay and other work requirements must be submitted by the applicant. Additionally, they must demonstrate that they had been working for the sending organization for at least 6 months prior to the start date, or 3 months in the case of trainees. Managers and specialists must present documentation of their education and work experience.

Proof that the Slovak company is a member of the same group of enterprises as the employer in the home country is also required, and so is confirmation that the employee will be able to return to work in their home country.

Requirements to fulfill by Slovak companies transferring employees

To sponsor ICT permits, the Slovak company must satisfy the following conditions:

  • it must be up to date with all tax duties and contributuons to pensions, social security, and health insurance;
  • it must not be undergoing forced administration, liquidation, or bankruptcy;
  • prior to application filing, the company’s employment history for the previous 5 years will be verified for abnormalities;
  • in the 5 years preceding to the application’s filing, the company must have not been subject to penalties for violations of working conditions;
  • the job offer or contract must adhere to all applicable laws;
  • the assigning entity and the host company in the Slovak Republic must be members of the same employer or group of businesses.

How to apply for Slovak employee transfer visas

Applications for Slovak personnel relocation visas must be filed with the Ministry of Interior. The following are the most important aspects to consider about them:

  • it takes about 90 days for an ICT visa to be issued;
  • the procedure can be reduced to 30 days for employers enrolled with Shared Services Centers in Slovakia;
  • the validity of the permit is maximum 3 years.
